Fine Increments LLC ("Fine Increments," "We," "Us," or "Our") is committed to protecting Your privacy. 2. INFORMATION WE COLLECT

We collect information through several channels. The following sections describe each category of data, what we collect, and how it is obtained.

2.1 Information You Provide Directly

  • Account Registration: When You create an account during checkout, we collect Your name, email address, and password. Your password is stored in encrypted form and is not accessible to Fine Increments staff.
  • Purchase Information: When You make a purchase, we collect Your billing address, and optionally Your phone number. Payment card details (credit card numbers, expiration dates, CVV codes) are collected and processed exclusively by our payment processor, Stripe, Inc., and are never transmitted to, stored on, or accessible from Fine Increments' servers.
  • Marketing Preferences: During checkout, You may choose to opt in to receive marketing communications by actively checking the marketing consent checkbox, which is unchecked by default. We record whether You opted in and the timestamp of Your consent.
  • Blog Comments: If You post comments on our blog, we collect the content of Your comment and the display name You provide.
  • Support Communications: If You contact us for support, we collect the content of Your communications, including any attachments, email addresses, and any other information You voluntarily provide.

2.2 Information Collected by Our Products

  • License Activation and Deactivation: When You activate or deactivate the Product, the software transmits Your License Key and a Hardware Fingerprint (a unique identifier generated from Your device's hardware characteristics) to our servers. Basic device information is also transmitted.
  • Trial Period: When You use the free trial, the Product transmits Your device's Hardware Fingerprint, IP address, device information, and trial status timestamps to our servers to manage trial eligibility and prevent abuse.
  • What We Do Not Collect From the Product: The Product does not collect, transmit, or monitor Your audio content, project files, DAW usage, creative work, browsing history, keystrokes, screen content, microphone or camera data, or any data from other applications on Your device. Once a perpetual license is activated, the Product does not perform any ongoing data collection or server communication.

2.3 Information Collected Automatically Through the Website

  • Cookies and Tracking Technologies: Our Website uses cookies and similar tracking technologies to collect information about Your browsing behavior. This includes analytics cookies (Google Analytics 4, deployed via Google Tag Manager), CRM and behavioral tracking (HubSpot), and advertising cookies (Meta Pixel, TikTok Pixel). These technologies collect data such as Your IP address, browser type and version, operating system, referring URLs, pages visited, time spent on pages, and interactions with Website elements.   • Server Logs: Our hosting provider (HostGator) and cloud services (Google Cloud) automatically collect standard server log data, including IP addresses, browser type, referring pages, and timestamps of requests.

2.4 Information From Third-Party Services

We may receive information about You from our third-party service providers, including: transaction confirmation data from Stripe (payment status, transaction amounts, and tax calculations); and analytics data from Google Analytics, HubSpot, Meta, and TikTok in aggregated or pseudonymized form.

4. THIRD-PARTY SERVICE PROVIDERS

We share Your personal data with the following categories of third-party service providers, solely for the purposes described in this Privacy Policy. We do not sell Your personal data to any third party.

Stripe, Inc. (Payment Processing): Processes all payment transactions, collects and stores payment card data, calculates and collects applicable taxes via Stripe Tax. Stripe's privacy policy is available at stripe.com/privacy. Stripe is PCI DSS Level 1 certified.

Google Cloud / Firebase (Infrastructure and Data Storage): Hosts our backend services, license database (Firestore), trial tracking, and API infrastructure. All data is stored in the United States. Google Cloud's data processing terms are available at cloud.google.com/terms/data-processing-addendum.

HostGator (Website Hosting): Hosts our Website. HostGator's servers are located in the United States. Standard server logs (IP addresses, browser information) are collected automatically.

HubSpot, Inc. (Customer Relationship Management and Website Tracking): We use HubSpot to manage customer relationships, track purchase and license data, send marketing communications to users who have opted in, and track visitor behavior on our Website via the HubSpot tracking script. Website behavioral data collected by HubSpot includes pages visited, session data, and form interactions, which are used for CRM and marketing automation purposes. Data shared with HubSpot includes Your name, email, purchase history, license information, marketing preferences, and, if provided, phone number and billing address. HubSpot's privacy policy is available at legal.hubspot.com/privacy-policy.

Google Analytics 4 / Google Tag Manager (Website Analytics): Collects anonymized and pseudonymized website usage data including pages visited, session duration, traffic sources, and user interactions. Google Analytics data is processed in accordance with Google's privacy policy at policies.google.com/privacy. We have configured Google Analytics to anonymize IP addresses where technically supported.

Meta Platforms, Inc. (Advertising): The Meta Pixel collects data about Website visits and interactions for the purpose of measuring advertising effectiveness and enabling remarketing. Data shared with Meta is governed by Meta's data policy at facebook.com/privacy/policy.

TikTok Inc. (Advertising): The TikTok Pixel collects data about Website visits and interactions for the purpose of measuring advertising effectiveness and enabling remarketing. Data shared with TikTok is governed by TikTok's privacy policy at tiktok.com/legal/privacy-policy.

We may also share Your data with: law enforcement or government authorities when required by law, subpoena, court order, or legal process; professional advisors (accountants, lawyers) under obligations of confidentiality; and successors in the event of a merger, acquisition, or sale of all or substantially all of our assets, in which case You will be notified.

5. DATA RETENTION

We retain Your personal data only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. The specific retention periods are as follows:

Account data (name, email, password)

  • Retention Period: Life of account + 3 years after deletion or last activity
  • Reason: Customer support, dispute resolution, statute of limitations

License records (keys, activation history)

  • Retention Period: Life of account + 3 years after deletion or last activity
  • Reason: License management, transfer verification, fraud prevention

Payment and transaction records

  • Retention Period: 7 years from transaction date
  • Reason: Tax compliance (IRS), financial record-keeping obligations

Trial data (fingerprints, IP addresses)

  • Retention Period: 2 years after trial expiration
  • Reason: Trial abuse prevention

Marketing consent records

  • Retention Period: 3 years after last interaction or until consent withdrawn (whichever is later)
  • Reason: Proof of consent (GDPR compliance)

Blog comments

  • Retention Period: Until deleted by user or removed by moderation
  • Reason: User-initiated content

Website analytics (GA4)

  • Retention Period: 14 months (Google's default retention)
  • Reason: Website improvement and traffic analysis

Support communications

  • Retention Period: 3 years after resolution
  • Reason: Quality assurance, dispute resolution

When retention periods expire, personal data is either permanently deleted or anonymized (stripped of all personally identifiable information) so that it can no longer be linked to You.

6. DATA DELETION

You may request deletion of Your personal data at any time by contacting support@fineincrements.com. Upon receiving a verified deletion request, we will:

Delete: Your account login credentials, marketing preferences and communication history, blog comments, trial tracking data, and any other personal data not subject to legal retention requirements.

Anonymize: Transaction and payment records will be anonymized (personal identifiers replaced with anonymous IDs) rather than deleted, as we are required to retain financial records for tax and legal compliance purposes for up to 7 years. License key records will be anonymized to prevent re-use while removing Your personal identity from the record.

Notify third parties: We will instruct our third-party service providers (HubSpot, TikTok, etc.) to delete or anonymize Your data in their systems, subject to their own retention policies and legal obligations.

We will complete deletion requests within thirty (30) days of receiving a verified request. If we require additional time (up to an additional sixty (60) days for complex requests), we will notify You of the delay and the reason.

Please note that deletion of Your account data will not affect the validity of any previously activated perpetual license, which will continue to function on devices where it has been activated.

7. COOKIES AND TRACKING TECHNOLOGIES

7.1 What Are Cookies

Cookies are small text files placed on Your device by websites You visit. They are widely used to make websites work more efficiently and to provide information to website owners. Similar technologies include web beacons, pixel tags, and local storage.

Please note that disabling essential cookies may impair Website functionality, including the checkout process and account login.

8. INTERNATIONAL DATA TRANSFERS

Fine Increments is based in the United States, and all personal data we collect is stored and processed in the United States. If You are located outside the United States (including in the European Union, European Economic Area, United Kingdom, Brazil, or other jurisdictions with data protection laws), Your personal data will be transferred to and processed in the United States.

9. DATA SECURITY

We implement appropriate technical and organizational measures to protect Your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Secure payment processing through Stripe (PCI DSS Level 1 certified); Fine Increments never receives, stores, or has access to Your payment card numbers.

  • Rate limiting and abuse detection on all public-facing API endpoints.
  • Webhook signature verification for all payment processor communications.
  • Regular security reviews of our codebase and infrastructure.

While we take reasonable precautions to protect Your data, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security, and You acknowledge that You provide Your personal data at Your own risk.

10.2 Additional Rights for EU, EEA, and UK Residents (GDPR / UK GDPR)

If You are located in Brazil, the Lei Geral de Proteção de Dados (LGPD) provides You with rights substantially similar to those described in Section 10.2, including the right to access, correction, anonymization, portability, deletion, information about sharing, and the right to revoke consent. 10.5 Response Timeframe

We will respond to all verified rights requests within thirty (30) days. If additional time is required (up to sixty (60) additional days for complex requests), we will notify You of the extension and the reason. There is no fee for exercising Your rights, unless a request is manifestly unfounded or excessive, in which case we may charge a reasonable fee or refuse the request.

11. CHILDREN'S PRIVACY

Our Website and Products are not directed at children under the age of thirteen (13). We do not knowingly collect personal information from children under 13. If You are between 13 and 18 years of age, You may only use our Website and Products with the consent and involvement of a parent or legal guardian. If we become aware that we have collected personal data from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly. 12. "DO NOT TRACK" SIGNALS

Some web browsers transmit "Do Not Track" (DNT) signals. There is currently no industry standard for how companies should respond to DNT signals. Our Website does not currently respond to DNT signals. However, You can manage Your tracking preferences through our cookie consent banner and Your browser settings as described in Section 7.

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors.
