Fine Increments LLC ("Fine Increments," "We," "Us," or "Our") is committed to protecting Your privacy. This Privacy Policy describes how we collect, use, store, share, and protect Your personal information when You visit our website at www.fineincrements.com ("Website"), use our audio plugin software products ("Products"), or otherwise interact with our services.

This Privacy Policy applies to all users of our Website and Products worldwide. Where specific rights or obligations apply only to residents of certain jurisdictions (such as the European Union, United Kingdom, California, or Brazil), these are identified in the relevant sections below.

By using our Website, creating an account, making a purchase, or using our Products, You acknowledge that You have read and understood this Privacy Policy. If You do not agree with our data practices, please do not use our Website or Products.

1. DATA CONTROLLER

2. INFORMATION WE COLLECT

We collect information through several channels. The following sections describe each category of data, what we collect, and how it is obtained.

2.1 Information You Provide Directly

  • Account Registration: When You create an account during checkout, we collect Your name, email address, and password. Your password is stored in encrypted form and is not accessible to Fine Increments staff.
  • Purchase Information: When You make a purchase, we collect Your billing address, optionally Your phone number, and, if You supply one, a business tax or VAT identification number. We also record Your acceptance of our Terms and Conditions, Your acknowledgement waiving the right of withdrawal for immediately delivered digital content, and any promotion or referral code You enter at checkout. Payment card details (credit card numbers, expiration dates, CVV codes) are collected and processed exclusively by our payment processor, Stripe, Inc., and are never transmitted to, stored on, or accessible from Fine Increments' servers.
  • Marketing Preferences: You may choose to opt in to receive marketing communications by actively checking a marketing consent checkbox, which is unchecked by default. This checkbox appears at checkout, when redeeming a license code, and on our download and free tool forms. We record whether You opted in and the timestamp of Your consent.
  • Download and Free Tool Forms: To download our installers, or to export a file from our free web-based tools, we ask for Your email address. When You submit one of these forms we collect Your email address, Your marketing consent choice, the address and title of the page You submitted from, and, where it is present on Your device, Your HubSpot visitor identifier cookie, which allows the submission to be associated with Your previous activity on our Website. When You download an installer, we also record which product You are downloading and Your IP address, which HubSpot uses to estimate Your approximate location (country, region and city). Installer download submissions are sent to HubSpot by our server; free tool submissions are sent to HubSpot directly from Your browser. We also store a marker in Your browser's local storage so that You are not asked again for the same product on the same browser.
  • License Code Redemption: If You redeem a license code obtained from a reseller or promotional partner, we collect Your name, email address, a password for the account we create, the redemption code itself, Your marketing consent choice, and Your IP address.
  • Product Reviews: If You submit a review of one of our Products, we collect the product reviewed, Your rating, the text of Your review, the display name You provide, and, if You provide one, Your job title or role. Reviews are published publicly on our Website together with the name and title You supply.
  • Blog Comments: If You post comments on our blog, we collect the content of Your comment and the display name You provide.
  • Support Communications: If You contact us for support, we collect the content of Your communications, including any attachments, email addresses, and any other information You voluntarily provide.

2.2 Information Collected by Our Products

  • License Activation and Deactivation: When You activate or deactivate the Product, the software transmits Your License Key and a Hardware Fingerprint (a unique identifier generated from Your device's hardware characteristics) to our servers. Basic device information is also transmitted.
  • Trial Period: When You use the free trial, the Product transmits Your device's Hardware Fingerprint, IP address, device information, and trial status timestamps to our servers to manage trial eligibility and prevent abuse.
  • What We Do Not Collect From the Product: The Product does not collect, transmit, or monitor Your audio content, project files, DAW usage, creative work, browsing history, keystrokes, screen content, microphone or camera data, or any data from other applications on Your device. Once a perpetual license is activated, the Product does not perform any ongoing data collection or server communication.

2.3 Information Collected Automatically Through the Website

  • Cookies and Tracking Technologies: Our Website uses cookies and similar tracking technologies to collect information about Your browsing behavior. This includes analytics cookies (Google Analytics 4, deployed via Google Tag Manager), CRM and behavioral tracking (HubSpot), advertising cookies (Meta Pixel, TikTok Pixel), and affiliate tracking (FirstPromoter). These technologies collect data such as Your IP address, browser type and version, operating system, referring URLs, pages visited, time spent on pages, and interactions with Website elements, including which of our free web tools You use, the actions You take in them, and the file formats You export from them. For full details on our cookie practices, including which of these are controlled by our consent banner and which are not, see Section 7.
  • Marketing Attribution: When You arrive at our Website through a marketing campaign link or an affiliate link, our server may record the campaign parameters or affiliate reference contained in that link, together with the time of Your arrival, in first-party cookies on Your device. Campaign parameters are recorded only if You have accepted the advertising category in our cookie banner. An affiliate reference is recorded whether or not You accept, because it also carries the discount that the affiliate link entitles You to; it is described, with our reasoning, in Sections 7.2 and 7.3.
  • Transaction and Security Records: We record the IP address associated with purchases, license code redemptions, discount and referral code attempts, and installer downloads. We use these records to enforce rate limits, to detect and block abusive traffic, and to investigate fraudulent transactions.
  • Server Logs: Our hosting provider (Cloudways) and cloud services (Google Cloud) automatically collect standard server log data, including IP addresses, browser type, referring pages, and timestamps of requests.

2.4 Information From Third-Party Services

We may receive information about You from our third-party service providers, including: transaction confirmation data from Stripe (payment status, transaction amounts, and tax calculations); affiliate attribution and commission data from FirstPromoter; and analytics data from Google Analytics, HubSpot, Meta, and TikTok in aggregated or pseudonymized form.

3. HOW WE USE YOUR INFORMATION

We use Your personal information for the following purposes:

4. THIRD-PARTY SERVICE PROVIDERS

We share Your personal data with the following categories of third-party service providers, solely for the purposes described in this Privacy Policy. We do not sell Your personal data for money. Certain advertising activity described below may nevertheless constitute "sharing" as that term is defined under California law; please see Section 10.3, which explains this and how to opt out.

Stripe, Inc. (Payment Processing): Processes all payment transactions, collects and stores payment card data, calculates and collects applicable taxes via Stripe Tax. Stripe's privacy policy is available at stripe.com/privacy. Stripe is PCI DSS Level 1 certified.

Google Cloud / Firebase (Infrastructure and Data Storage): Hosts our backend services, license database (Firestore), trial tracking, and API infrastructure. All data is stored in the United States. Google Cloud's data processing terms are available at cloud.google.com/terms/data-processing-addendum.

Cloudways (Website Hosting): Hosts our Website on DigitalOcean servers located in the United States. Standard server logs (IP addresses, browser information) are collected automatically.

HubSpot, Inc. (Customer Relationship Management and Website Tracking): We use HubSpot to manage customer relationships, track purchase and license data, send marketing communications to users who have opted in, and track visitor behavior on our Website via the HubSpot tracking script. Website behavioral data collected by HubSpot includes pages visited, session data, and form interactions, which are used for CRM and marketing automation purposes. Data shared with HubSpot includes Your name, email, purchase history, license information, marketing preferences, marketing campaign attribution, affiliate and referral codes, applied discounts, the address and title of any page from which You submitted a form, the product and Your IP address when You submit an installer download form, and, if provided, phone number and billing address. HubSpot's privacy policy is available at legal.hubspot.com/privacy-policy.

FirstPromoter (Igil Webs SRL) (Affiliate Program Management): We operate an affiliate program through FirstPromoter. Their tracking script records affiliate link clicks, and loads only if You have accepted the advertising category in our cookie banner. When a purchase is attributed to an affiliate, we additionally report that sale to FirstPromoter from our own servers, sharing Your email address, the sale amount before tax, the currency, and the transaction identifier, so that the referring affiliate can be credited a commission. This server-side report is made independently of Your browser and is not affected by browser-based tracking protection. FirstPromoter's privacy policy is available at firstpromoter.com/privacy.

Google Analytics 4 / Google Tag Manager (Website Analytics): Collects anonymized and pseudonymized website usage data including pages visited, session duration, traffic sources, and user interactions. Google Analytics 4 does not log or store full IP addresses; IP addresses are used in transit to derive coarse location and are then discarded. Google Analytics data is processed in accordance with Google's privacy policy at policies.google.com/privacy.

Meta Platforms, Inc. (Advertising): The Meta Pixel records Website visits and conversion events so that we can measure the effectiveness of advertising we run on Meta's platforms. We do not operate remarketing or custom audiences. The pixel does not load at all unless You have accepted the advertising category in our cookie banner, and we set Meta's Limited Data Use flag, which restricts Meta to processing the data on our behalf rather than for its own purposes. Data shared with Meta is governed by Meta's data policy at facebook.com/privacy/policy.

TikTok Inc. (Advertising): The TikTok Pixel records Website visits and conversion events so that we can measure the effectiveness of advertising we run on TikTok. We do not operate remarketing or custom audiences. The pixel does not load at all unless You have accepted the advertising category in our cookie banner, and we set TikTok's Limited Data Use option. Data shared with TikTok is governed by TikTok's privacy policy at tiktok.com/legal/privacy-policy.

Content Delivery Networks and Embedded Media: Our Website loads fonts, stylesheets, and scripts from third-party content delivery networks, including Google Fonts, jsDelivr, and Cloudflare, and certain pages embed media hosted by YouTube and SoundCloud. When Your browser requests these resources, the provider receives Your IP address, browser type, and the address of the page You are viewing. We use YouTube's privacy-enhanced mode, which does not set advertising cookies unless You play a video.

We may also share Your data with: law enforcement or government authorities when required by law, subpoena, court order, or legal process; professional advisors (accountants, lawyers) under obligations of confidentiality; and successors in the event of a merger, acquisition, or sale of all or substantially all of our assets, in which case You will be notified.

5. DATA RETENTION

We retain Your personal data only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. The specific retention periods are as follows:

Account data (name, email, password)

  • Retention Period: Life of account + 3 years after deletion or last activity
  • Reason: Customer support, dispute resolution, statute of limitations

License records (keys, activation history)

  • Retention Period: Life of account + 3 years after deletion or last activity
  • Reason: License management, transfer verification, fraud prevention

Payment and transaction records

  • Retention Period: 7 years from transaction date
  • Reason: Tax compliance (IRS), financial record-keeping obligations

Trial data (fingerprints, IP addresses)

  • Retention Period: 2 years after trial expiration
  • Reason: Trial abuse prevention

Marketing consent records

  • Retention Period: 3 years after last interaction or until consent withdrawn (whichever is later)
  • Reason: Proof of consent (GDPR compliance)

Download and free tool form submissions

  • Retention Period: 3 years after last interaction, or until consent is withdrawn
  • Reason: Delivery of requested files, marketing communications, and lead management

Marketing attribution cookies (affiliate and campaign)

  • Retention Period: 60 days (affiliate) and 90 days (campaign) from the referring visit
  • Reason: Attribution window for affiliate commissions and campaign measurement

Transaction and security IP records

  • Retention Period: 2 years
  • Reason: Fraud prevention, abuse detection, and rate limiting

Product reviews

  • Retention Period: Until deleted by user or removed by moderation
  • Reason: User-initiated public content

Blog comments

  • Retention Period: Until deleted by user or removed by moderation
  • Reason: User-initiated content

Website analytics (GA4)

  • Retention Period: 14 months (the longest Google offers for event-level data; Google's own default is 2 months)
  • Reason: Website improvement and traffic analysis

Support communications

  • Retention Period: 3 years after resolution
  • Reason: Quality assurance, dispute resolution

When retention periods expire, personal data is either permanently deleted or anonymized (stripped of all personally identifiable information) so that it can no longer be linked to You.

6. DATA DELETION

You may request deletion of Your personal data at any time by contacting support@fineincrements.com. Upon receiving a verified deletion request, we will:

Delete: Your account login credentials, marketing preferences and communication history, download and free tool form submissions, product reviews, blog comments, trial tracking data, and any other personal data not subject to legal retention requirements.

Anonymize: Transaction and payment records will be anonymized (personal identifiers replaced with anonymous IDs) rather than deleted, as we are required to retain financial records for tax and legal compliance purposes for up to 7 years. License key records will be anonymized to prevent re-use while removing Your personal identity from the record.

Notify third parties: We will instruct our third-party service providers (HubSpot, FirstPromoter, TikTok, etc.) to delete or anonymize Your data in their systems, subject to their own retention policies and legal obligations. Please note that records of affiliate-attributed sales held by our affiliate program provider may be retained by that provider for commission accounting and dispute resolution.

We will complete deletion requests within thirty (30) days of receiving a verified request. If we require additional time (up to an additional sixty (60) days for complex requests), we will notify You of the delay and the reason.

Please note that deletion of Your account data will not affect the validity of any previously activated perpetual license, which will continue to function on devices where it has been activated.

7. COOKIES AND TRACKING TECHNOLOGIES

7.1 What Are Cookies

Cookies are small text files placed on Your device by websites You visit. They are widely used to make websites work more efficiently and to provide information to website owners. Similar technologies include web beacons, pixel tags, and local storage.

7.2 Cookies We Use

Essential Cookies (Fine Increments)

  • Purpose: Session management, account login, shopping cart, security, and recording Your cookie consent choices. The two Stripe cookies are set only on our checkout page, by our payment processor, to detect and prevent payment fraud
  • Consent Required: No (strictly necessary)
  • Cookie Names: SSESS*, SESS*, CSRF-Token, cookie-agreed, cookie-agreed-categories, and, on our checkout page only, __stripe_mid and __stripe_sid

Analytics Cookies (Google Analytics 4 via GTM)

Campaign Attribution Cookies (Fine Increments)

  • Purpose: Records the marketing campaign that first referred You and the most recent campaign before Your purchase, so that we can measure which campaigns are effective

Affiliate Tracking Cookies (FirstPromoter)

  • Purpose: Affiliate click tracking and commission attribution

Local Storage (Fine Increments)

  • Purpose: Records that You have already completed a download or free tool form, so that You are not asked for Your email address again on the same browser
  • Consent Required: No (strictly necessary to the function You requested)
  • Names: wf_download_gate_passed (stored until You clear Your browser data)

7.3 Cookie Consent

When You first visit our Website, You will be presented with a cookie consent banner that allows You to accept or reject non-essential cookies by category (analytics and advertising). Essential cookies that are strictly necessary for the Website to function do not require consent and cannot be disabled. Your cookie preferences are saved and can be changed at any time using the cookie settings tab displayed at the edge of the Website.

If You reject non-essential cookies, or simply do not accept them, the Meta Pixel, the TikTok Pixel, the HubSpot tracking script and our affiliate tracking script are not loaded at all. No analytics, advertising or CRM cookies are stored or read, no CRM tracking of Your browsing behavior takes place, and those providers are not contacted by Your browser. Where the corresponding consent has not been given, we also actively delete any analytics and advertising cookies already present on Your device.

Some things do load before You make a choice, and we would rather say so than leave You to find out. Our tag manager and analytics (Google Tag Manager and Google Analytics) load on every page; they are configured so that no analytics cookies are stored on Your device until You consent, but Your browser does contact Google in order to load them. On the pages that carry one of our forms -- our contact page, and our download and free tool pages -- HubSpot's form-embedding script also loads, because the form cannot be displayed without it; it is not loaded on any other page. Our Website additionally loads fonts and stylesheets from content delivery networks, as described in Section 4. In each of these cases the provider receives Your IP address, browser type and the address of the page You are viewing.

One cookie is deliberately not gated. Where You arrive through an affiliate link, our server records the affiliate reference in the wf_aff cookie whether or not You accept cookies, because that same reference applies the discount the affiliate link entitles You to. Withholding it would quietly charge You full price and deny the affiliate the commission they earned by referring You. It contains only the affiliate token from the link You followed, it is never set for visitors who arrive by any other route, and You can remove it through Your browser settings.

Separately, where a purchase is attributed to an affiliate, we report that sale to FirstPromoter from our servers as described in Section 4. That report does not depend on cookies or on any script running in Your browser, and is therefore unaffected by Your cookie choices or by browser-based tracking protection.

You can remove any of the cookies described above, including those not controlled by our banner, through Your browser settings as described in Section 7.4.

7.4 Browser Controls

In addition to our cookie consent mechanism, You can control cookies through Your browser settings. Most browsers allow You to refuse cookies, delete existing cookies, or be notified when a cookie is set. Please note that disabling essential cookies may impair Website functionality, including the checkout process and account login.

8. INTERNATIONAL DATA TRANSFERS

Fine Increments is based in the United States, and the substantial majority of the personal data we collect is stored and processed in the United States. If You are located outside the United States (including in the European Union, European Economic Area, United Kingdom, Brazil, or other jurisdictions with data protection laws), Your personal data will be transferred to and processed in the United States.

One exception applies. Our affiliate program is operated by FirstPromoter (Igil Webs SRL), which is established in Romania, in the European Union. Affiliate attribution and commission data, including the email address and purchase amount associated with an affiliate-attributed sale, is therefore processed within the European Union rather than the United States.

The United States may not provide the same level of data protection as Your home jurisdiction. By using our Website or Products, You consent to the transfer of Your data to the United States. For users in the European Union and the United Kingdom, we rely on the following transfer mechanisms as applicable: (a) Standard Contractual Clauses (SCCs) as adopted by the European Commission, where required by our third-party service providers; (b) adequacy decisions, where applicable; and (c) Your explicit consent to the transfer as provided at the time of account creation and purchase.

Our third-party service providers (Stripe, Google, HubSpot, FirstPromoter, Meta, TikTok) maintain their own data transfer mechanisms for international transfers. We encourage You to review their respective privacy policies for details on their cross-border data transfer practices.

9. DATA SECURITY

We implement appropriate technical and organizational measures to protect Your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encrypted data transmission (HTTPS/TLS) for all Website and API communications.
  • Encrypted storage of passwords and sensitive credentials.
  • Secure payment processing through Stripe (PCI DSS Level 1 certified); Fine Increments never receives, stores, or has access to Your payment card numbers.
  • Access controls and authentication requirements for administrative systems.
  • Rate limiting and abuse detection on all public-facing API endpoints.
  • Webhook signature verification for all payment processor communications.
  • Regular security reviews of our codebase and infrastructure.

While we take reasonable precautions to protect Your data, no method of electronic transmission or storage is completely secure. We cannot guarantee absolute security, and You acknowledge that You provide Your personal data at Your own risk.

10. YOUR RIGHTS

Depending on Your location, You may have the following rights regarding Your personal data. To exercise any of these rights, contact support@fineincrements.com.

10.1 Rights for All Users

  • Access: You may request a copy of the personal data we hold about You.
  • Correction: You may request that we correct inaccurate or incomplete personal data.
  • Deletion: You may request deletion of Your personal data, subject to the retention requirements described in Sections 5 and 6.
  • Marketing opt-out: You may withdraw consent for marketing communications at any time by clicking "unsubscribe" in any marketing email or by contacting us.

10.2 Additional Rights for EU, EEA, and UK Residents (GDPR / UK GDPR)

If You are located in the European Union, European Economic Area, or United Kingdom, You additionally have the right to:

  • Restriction of processing: Request that we restrict the processing of Your personal data in certain circumstances.
  • Data portability: Receive Your personal data in a structured, commonly used, machine-readable format and transmit it to another controller.
  • Object to processing: Object to the processing of Your personal data based on legitimate interests, including profiling and including the marketing attribution described in Sections 2.3 and 3.
  • Withdraw consent: Where processing is based on consent, withdraw Your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
  • Lodge a complaint: Lodge a complaint with Your local data protection supervisory authority. A list of EU supervisory authorities is available at edpb.europa.eu.

10.3 Additional Rights for California Residents (CCPA / CPRA)

To the extent that this is nonetheless treated as "sharing" for cross-context behavioral advertising under the CCPA/CPRA, You may opt out at any time by rejecting the advertising category in our cookie consent banner, which You can reopen using the cookie settings tab displayed at the edge of any page, or by contacting us at support@fineincrements.com. We also honor the Global Privacy Control (GPC) signal: if Your browser sends it, we treat it as an opt-out automatically and it overrides any prior consent You gave us.
  • Non-discrimination: We will not discriminate against You for exercising any of Your CCPA/CPRA rights.

10.4 Additional Rights for Brazilian Residents (LGPD)

If You are located in Brazil, the Lei Geral de Proteção de Dados (LGPD) provides You with rights substantially similar to those described in Section 10.2, including the right to access, correction, anonymization, portability, deletion, information about sharing, and the right to revoke consent. 10.5 Response Timeframe

We will respond to all verified rights requests within thirty (30) days. If additional time is required (up to sixty (60) additional days for complex requests), we will notify You of the extension and the reason. There is no fee for exercising Your rights, unless a request is manifestly unfounded or excessive, in which case we may charge a reasonable fee or refuse the request.

11. CHILDREN'S PRIVACY

Our Website and Products are not directed at children under the age of thirteen (13). We do not knowingly collect personal information from children under 13. If You are between 13 and 18 years of age, You may only use our Website and Products with the consent and involvement of a parent or legal guardian. If we become aware that we have collected personal data from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly. 12. "DO NOT TRACK" AND OPT-OUT PREFERENCE SIGNALS

Our Website honors the Global Privacy Control (GPC) signal. If Your browser or an extension sends it, we treat it as a withdrawal of consent for advertising and marketing: no advertising, CRM or affiliate tracking scripts are loaded, no campaign attribution cookie is set, and the signal overrides any consent previously recorded through our cookie banner. We honor it both in Your browser and on our servers. Some browsers also transmit an older "Do Not Track" (DNT) signal, for which no industry standard was ever agreed and to which our Website does not respond; if You rely on DNT, please use our cookie consent banner or GPC instead.
